The Supreme Court of India ruled that homebuyers can claim compensation for delayed possession even after taking over the flat. A bench comprising Justice Vikram Nath and Justice V. Mohana set aside a 2016 order by the National Consumer Disputes Redressal Commission (NCDRC) which had stated that a person is no longer a consumer once they take possession without protest. The court emphasized that the Consumer Protection Act, 1986 is a welfare legislation designed to provide simple and fast remedies. The apex court revived the consumer complaint and directed the Dwarka District Consumer Disputes Redressal Commission to decide the matter on its merits after hearing both parties.
