#Social_Issues 🔴 What happened in West Bengal? 👉 The West Bengal Assembly passed two amendment Bills that: Removed 77 communities that had previously been added to the state's OBC list. Restored the OBC reservation structure to 7% for 66 recognised OBC communities. Amended the functioning of the State Backward Classes Commission. These changes were made following the Calcutta High Court's May 2024 judgment, which struck down the inclusion of those communities because the court held that the process used to identify them did not comply with constitutional requirements. The court observed that the identification exercise had not followed a proper contemporaneous survey and that religion had effectively become the determining factor, which it found unconstitutional. 🔴 Does the Constitution provide reservation only for Hindus? No. Under the Constitution: 👉 SC (Scheduled Caste) reservation is religion-linked in a limited way because the Presidential Orders currently restrict SC status primarily to Hindus, Sikhs and Buddhists. 👉 ST (Scheduled Tribe) reservation is generally not religion-specific. 👉 OBC reservation is not restricted to Hindus. Any community—Hindu, Muslim, Christian, Sikh or others—may be recognised as OBC if it is found to be socially and educationally backward through the prescribed legal process. Therefore, Muslims or Christians can legally be included in OBC lists, provided the inclusion is based on objective backwardness and follows constitutional procedures. It is not automatically illegal merely because the beneficiaries belong to a particular religion. 🔴 Why did the Calcutta High Court strike down the West Bengal list? The High Court did not hold that Muslims can never receive an OBC reservation. 👉 Instead, it held that: the State had not followed the statutory procedure properly; adequate empirical data and surveys were lacking; religion appeared to have become the dominant criterion instead of measurable backwardness.
