#🆕 ताजा अपडेट #🌐 राष्ट्रीय अपडेट #📢 ताज़ा खबर 🗞️ सुप्रीम कोर्ट ने आपसी सहमति से तलाक के मामलों में एक महत्वपूर्ण फैसला सुनाया है। शीर्ष अदालत ने कहा कि अगर पति-पत्नी ने आपसी सहमती के जरिए सभी विवादों का पूर्ण और अंतिम निपटारा कर लिया है, तो बाद में कोई भी पक्ष मनमाने ढंग से अपनी सहमति वापस नहीं ले सकता है। मामले की शुरुआत 2000 में हुई शादी से हुई। 2023 में पति ने तलाक की याचिका दायर की, जिसके बाद फैमिली कोर्ट ने मामले को मध्यस्थता के लिए भेजा। दोनों पक्षों ने मध्यस्थता में समझौता किया। पति ने पत्नी को 1.5 करोड़ रुपये दो किस्तों में देने, 14 लाख रुपये की कार और कुछ जेवर देने पर सहमति जताई। बदले में पत्नी ने जॉइंट बिजनेस अकाउंट से 2.5 करोड़ रुपये पति को ट्रांसफर करने पर राजी हुई। दोनों ने मिलकर तलाक याचिका दाखिल की और आंशिक भुगतान भी किया। लेकिन दूसरी मोशन से पहले पत्नी ने सहमति वापस ले ली और घरेलू हिंसा कानून के तहत शिकायत दर्ज कराई। पत्नी का दावा था कि लिखित समझौते के अलावा पति ने मौखिक रूप से 120 करोड़ के जेवर और 50 करोड़ के सोने के बिस्किट देने का वादा किया था, जो टैक्स बचाने के लिए लिखित रूप में नहीं डाला गया। जस्टिस राजेश बिंदल और जस्टिस विजय बिश्नोई की पीठ ने कहा कि आपसी सहमति से तलाक में सामान्यतः कोई भी पक्ष अंतिम डिक्री से पहले सहमति वापस ले सकता है, लेकिन जब मध्यस्थ द्वारा प्रमाणित समझौता अदालत द्वारा स्वीकार कर लिया जाता है, तो वह मूल विवाद को बदल देता है। ऐसे समझौते से पीछे हटना न्यायिक प्रक्रिया और मध्यस्थता व्यवस्था की बुनियाद पर चोट है। पीठ ने पत्नी पर भारी लागत लगाई और समझौते से पीछे हटने को मध्यस्थता के दुरुपयोग करार दिया। पत्नी की घरेलू हिंसा शिकायत को 23 साल की शादी में कोई आरोप न होने के कारण ‘आफ्टरथॉट’ बताया। अदालत ने अनुच्छेद 142 के तहत शादी को तलाक दे दिया, घरेलू हिंसा के मामले रद किए और पति को बकाया राशि चुकाने का निर्देश दिया। #SupremeCourt #DivorceCase #Newsgenix
